Kişisel Verilerin İşlenmesi Aydınlatma Metni Disclosure Notice on the Processing of Personal Data

6698 sayılı Kişisel Verilerin Korunması Kanunu'nun ("KVKK") 'Veri Sorumlusunun Aydınlatma Yükümlülüğü' başlıklı 10. Maddesi uyarınca veri sorumlusu olan şirketimiz İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ (İNNOBİ) kimliği, kişisel veri işleme amaçları, kişisel verilerin aktarıldığı kişiler ve aktarma amaçları, kişisel verilerin toplanmasının hukuki sebepleri ve yöntemleri, kişisel veri sahibinin veri sorumlusuna yönelteceği KVKK'nın 11'inci maddesinde sayılan hakları konusunda veri sahiplerini bilgilendirme yükümlülüğü bulunmaktadır. Bu madde uyarınca işbu Aydınlatma Metni, KVKK'nın 10'uncu maddesi hükmü uyarınca siz veri sahipleri aydınlatma amacı ile hazırlanmıştır.

Pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data ("KVKK"), titled 'Obligation to Inform of the Data Controller', our company İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ ("İNNOBİ"), acting as data controller, is obliged to inform data subjects of its identity, the purposes of processing personal data, the parties to whom personal data are transferred and the purposes of such transfer, the legal grounds and methods of collecting personal data, and the rights listed in Article 11 of the KVKK that data subjects may exercise against the data controller. This Disclosure Notice has been prepared pursuant to Article 10 of the KVKK for the purpose of informing you, the data subjects.

a. Veri Sorumlusunun Kimliği a. Identity of the Data Controller

KVKK'nın 3/1 (ı) maddesinde de veri sorumlusu, 'Kişisel verilerin işleme amaçlarını ve vasıtalarını belirleyen, veri kayıt sisteminin kurulmasından ve yönetilmesinden sorumlu olan gerçek veya tüzel kişiler' olarak tanımlanmıştır. KVKK'nın 'Veri Sorumlusunun Aydınlatma Yükümlülüğü' başlıklı 10/1 (a) maddesinde de veri sahibine, veri sorumlusunun kimliği konusunda bilgi verilmesi yükümlülüğünü getirmiştir. İNNOBİ, gerek bu internet sitesi gerekse diğer mecralarda bizimle paylaştığınız kişisel verileriniz sebebiyle KVKK kapsamında, 'veri sorumlusu' sıfatına haiz olabilir. Bu çerçevede 'veri sorumlusunun kimliği', Türkiye Cumhuriyeti kanunlarına uygun şekilde anonim şirket olarak kurulmuş olup, İstanbul Ticaret Odası'na 732529 sicil numarası ile kayıtlı, 0924077911900001 Mersis numaralı, şirket merkezi YTÜ TeknoPark Çifte Havuzlar Mah. Eski Londra Asfaltı Cad. Kuluçka Mrk. D2 Blok 151/1f 1b11 ISTANBUL, Esenler 34220, TR adresinde bulunan İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ'dir.

Article 3/1(ı) of the KVKK defines a data controller as "the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data filing system." Article 10/1(a) of the KVKK, titled "Obligation to Inform of the Data Controller," requires that the data subject be informed of the identity of the data controller. İNNOBİ may hold the status of "data controller" under the KVKK with respect to the personal data you share with us through this website or other channels. In this context, the identity of the data controller is İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ, a joint-stock company duly established under the laws of the Republic of Türkiye, registered with the İstanbul Chamber of Commerce under registration number 732529, with MERSİS number 0924077911900001, having its registered office at YTÜ TeknoPark Çifte Havuzlar Mah. Kişisel Verileriniz KVKK'nın 5'inci maddesinde belirtilen kişisel veri işleme şartlarından bir veya birkaçına dayalı olarak, KVKK'nın 4'üncü maddesinde belirtilen kişisel veri işleme ilkelerine uygun şekilde işlenmektedir. Your personal data is processed on the basis of one or more of the personal data processing conditions set out in Article 5 of the KVKK, and in accordance with the personal data processing principles set out in Article 4 of the KVKK. All personal data processing activities carried out by İNNOBİ are conducted in compliance with the obligations required under the KVKK and other applicable legislation. The purposes of processing your personal data, within the scope of the processing conditions and purposes set out in Articles 5 and 6 of the KVKK, include: carrying out the work necessary for our business units to allow you to benefit from the products and services offered by our Company; improving, developing and diversifying our products and services and recommending them to you customized to your preferences, usage habits and needs; ensuring the legal and commercial security of our Company and of persons with whom our Company has a business relationship; carrying out the necessary quality and standard audits; and determining and implementing our Company's commercial and business strategies. Kişisel verileriniz şirketimiz İNNOBİ tarafından, ticari faaliyetlerimizi yürütmek amacıyla işbu internet sitesinin kullanımı ile yaptığınız kayıtlar, her türlü bilgi formları, anketler, iş başvuru formları, iş sözleşmeleri, sosyal medya uygulamaları, çağrı merkezleri ve Şirketimiz ile akdetmiş olduğunuz sözleşmeler dahil ancak burada sayılanlarla sınırlı olmamak üzere farklı kanallarla ve yasalara uygun olarak toplanmaktadır. Your personal data is collected by our company İNNOBİ, for the purpose of carrying out our commercial activities, through various channels and in compliance with applicable law — including, but not limited to, the records you create through the use of this website, information forms of all kinds, surveys, job application forms, employment contracts, social media applications, call centers, and contracts you enter into with our Company. Your personal data may also be processed and transferred for the purposes set out in this Disclosure Notice, within the scope of the personal data processing conditions and purposes set out in Articles 5 and 6 of the KVKK.

e. Kişisel Veri Sahibinin Hakları e. Rights of the Personal Data Subject

Kişisel veri sahipleri olarak, haklarınıza ilişkin taleplerinizi www.innobi.com.tr internet adresinden kamuoyu ile paylaşılmış olan İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ Kişisel Verilerin İşlenmesi ve Korunması Politikası'nda düzenlenen yöntemlerle tarafımıza iletebilirsiniz. İNNOBİ, talebin niteliğine göre talebi en kısa sürede ve en geç otuz (30) gün içinde ücretsiz olarak sonuçlandıracaktır. Kişisel Verileriniz ile ilgili olarak şirketimizden talep ettiğiniz bilgilerin teminin ayrıca bir maliyeti gerektirmesi hâlinde, bu bilgiler Kişisel Verileri Koruma Kurulunca belirlenen tarifedeki ücretin ödenmesi koşulu ile temin edilecektir. Kişisel verisi işlenen gerçek kişilerin KVKK'nın 11. maddesi uyarınca sahip olduğu haklar aşağıdaki gibidir:

• Kişisel veri işlenip işlenmediğini öğrenme,
• Kişisel verileri işlenmişse buna ilişkin bilgi talep etme,
• Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme,
• Yurt içinde veya yurt dışında kişisel verilerin aktarıldığı üçüncü kişileri bilme,
• Kişisel verilerin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• KVKK ve ilgili diğer kanun hükümlerine uygun olarak işlenmiş olmasına rağmen, işlenmesini gerektiren sebeplerin ortadan kalkması hâlinde kişisel verilerin silinmesini veya yok edilmesini isteme ve bu kapsamda yapılan işlemin kişisel verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme,
• İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle kişinin kendisi aleyhine bir sonucun ortaya çıkmasına itiraz etme,
• Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğraması hâlinde zararın giderilmesini talep etme.

As personal data subjects, you may submit your requests regarding your rights to us through the methods set out in the İNNOBİ BİLİŞİM VE DANIŞMANLIK HİZMETLERİ ANONİM ŞİRKETİ Personal Data Processing and Protection Policy, published at www.innobi.com.tr. Depending on the nature of the request, İNNOBİ will conclude the request free of charge, as soon as possible and within thirty (30) days at the latest. Where obtaining the information you request regarding your personal data requires an additional cost, such information will be provided subject to payment of the fee set out in the tariff determined by the Personal Data Protection Board. The rights that natural persons whose personal data is processed have under Article 11 of the KVKK are as follows:

• To learn whether personal data is being processed,
• To request information if personal data has been processed,
• To learn the purpose of processing personal data and whether it is used in accordance with that purpose,
• To know the third parties, in the country or abroad, to whom personal data is transferred,
• To request correction of incomplete or inaccurate personal data and to request that this correction be notified to the third parties to whom the personal data has been transferred,
• To request the deletion or destruction of personal data if the reasons requiring its processing no longer exist, even where the data has been processed in compliance with the KVKK and other applicable laws, and to request that this be notified to the third parties to whom the personal data has been transferred,
• To object to the emergence of a result against the person by analysis of the processed data exclusively through automated systems,
• To request compensation for damages suffered as a result of the unlawful processing of personal data.

Yasal zorunluluk ve sözleşmesel ilişkilerimiz sebebiyle kaydettiklerimiz saklı kalmak kaydıyla, kişisel verilerinizden, sizi ürünlerimiz ve hizmetlerimiz konusunda bilgilendirebilmek amacı ile yararlanmak istiyoruz. Kişisel Verileriniz ile ilgili bilgi edinmek istemeniz halinde ekli başvuru formunu doldurarak, şirketimize göndermenizi rica ediyoruz. Talebiniz 30 gün içinde cevaplanacaktır.

Under the KVKK, our Company is obliged to inform you as to whether your personal data recorded by our Company exists, and, if so, to allow you to view it and, where necessary, to delete or amend it. If you wish to obtain information regarding your personal data, please fill in the attached application form and send it to our company. Your request will be answered within 30 days.
